(1) If a member elected according to the proportional election system dies, resigns, leaves the party or becomes vacant for any other reason, the Secretariat of the Provincial Assembly shall inform the Commission.
(2) After receiving the information that the position is vacant according to sub-rule (1), the Commission will inform the relevant party by giving seven days time to nominate and send the name of another candidate.
(3) After receiving the information as per sub-rule (2), the relevant party shall nominate and send the name of another candidate who remains in the closed list of candidates according to the decision of the party's central executive committee or similar committee.
(4) When the party nominates and sends a candidate according to sub-rule (3), the name of the candidate of the inclusive group in which the position of the member of the inclusive group is vacant shall be nominated and sent as long as it is available.
(5) According to sub-rule (3), the Commission shall declare the candidates nominated and sent by the party to be elected as members.
